What is the Landscape on Canadian Privacy Laws?
Canada’s data protection framework is a combination of federal and provincial laws. The federal Personal Information Protection and Electronic Documents Act (PIPEDA) applies among others to private-sector organizations conducting commercial activities across provinces. However, some provinces like Quebec, Alberta, and British Columbia have adopted their own privacy laws deemed “substantially similar” to PIPEDA and others such as Ontario, New Brunswick and Nova Scotia have similar provincial health information laws.
For Life Sciences companies operating across Canadian provinces, understanding and complying with complementary and sectorial laws is a legal puzzle requiring strategic advice. At MyData-TRUST, we provide expert support to ensure your activities align with both federal and provincial privacy obligations.

Understanding the Canadian Privacy Framework
PIPEDA: Federal Regulation
PIPEDA governs among others how private-sector organizations collect, use, and disclose personal information during commercial activities. It is enforced by the Office of the Privacy Commissioner of Canada (OPC).
Provincial Regulations
Some provinces have their own private sector privacy laws deemed substantially similar to PIPEDA:
- Quebec (Law 25, formerly Bill 64)
- British Columbia (Personal Information Protection Act - PIPA)
- Alberta (PIPA Alberta)
There are also four provincial health information laws that are considered substantially similar to PIPEDA. These laws apply to personal health information within their respective provinces.
Organizations operating in multiple provinces must adapt their privacy programs to comply with each jurisdiction’s unique requirements.
Why Compliance with Canadian Privacy Laws Matters
- Mandatory for organizations handling personal information within the legal scope of application
- Varies by province and business model (federal vs. intra-provincial)
- Crucial for managing sensitive health and clinical data in research contexts
- Builds trust with Canadian patients, regulators, and partners
