Frequently asked questions
Does Argentina already have a data protection law in force?
Yes. Argentina’s Personal Data Protection Law (Law 25.326) is a long-standing law that is already in force and remains fully applicable, and Argentina holds EU adequacy status. Several bills to modernise this framework have been submitted to the Argentine Congress, but none have been approved yet, so we cannot estimate when a reform will come into effect.
Can data be transferred outside of Argentina?
Yes, but there are rules you must follow, whether the country has an adequacy decision from the Argentine agency, or the implementation of Contractual Clauses Models, among other mechanisms.
Are there penalties for noncompliance with the law?
Yes, depending on the type of violation, you may be subject to administrative (warning, suspension, fines, closure or cancellation of the file, registry, or data bank) or even criminal penalties (Imprisonment).
